Both the Fifth and the Eighth Circuits issued decisions yesterday. Biden* is prohibited from implementing the CMS order in 25 States.
He is also allowed to implement the CMS order in the other 25 States (including Wisconsin.)
We'll see what SCOTUS has to say soon.
