Bolton's "Argument" v. Arizona? A Laugher

Maybe stupid ideological argumentation works in the salons of DC.

It doesn't work so well in real life.

[District Court judge] Bolton, a Democratic appointee, also questioned a core part of the Justice Department’s argument that she should declare the law unconstitutional: that it is “preempted” by federal law because immigration enforcement is an exclusive federal prerogative.

“How is there a preemption issue?” the judge asked. “I understand there may be other issues, but you’re arguing preemption. Where is the preemption if everybody who is arrested for some crime has their immigration status checked?”

Oh, well. Maybe the "They ate our homework" argument will be next.

If you read the original article on the WaPo site the true laugher is when the Feds are arguing for preemption because having Arizona send all those illegals to ICE would overwhelm them.

Translation - we'd be too busy to do our jobs.

Maybe we should hire more ICE folks instead of all those new IRS agents. Hmmm?
