One expects that the media will do everything they can to destroy Donald Trump. OK, we get that.
So when they editorialize--render an opinion--on an issue and call it "hard news", we're not surprised. But we are disappointed.
Here, a person named "Emily Pofahl" creates her own definition of the 14th Amendment:
...Birthright citizenship is enshrined in the 14th Amendment of the Constitution and says that anyone born on U.S. soil is a U.S. citizen, no matter what their parents' immigration status is....
No, little girl, that is NOT what the 14th says. In pertinent part we have this:
...All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws....
You may WISH that "....subject to the jurisdiction thereof...." means that the "Magic Dirt" theory applies; that is, that if you exited the womb within the USA you are automatically "subject to the jurisdiction thereof."
But wishes ain't horses, nor citizens, Emily. That particular clause is debatable AND debated. It may eventuate that SCOTUS believes the "Magic Dirt" theory--and it may not.
And Emily: Thanks for making it clear that Channel 12 is just another piece of the media dirt.
