How Bradley Ushers in George Soros

You've seen a few combox items and/or blogposts from the Lefties citing the Bradley v. Prosser dustup as justification for this.

Soros has spent several million dollars in the past decade in an attempt to get more states to scrap elections and adopt the merit method. Supporters say it would allow judges to focus on interpreting the law rather than on raising campaign funds and winning elections...

"Merit" selection means that you put a bunch of lawyers in a room and they nominate a few folks; one of them gets appointed by the Governor.

IOW, to avoid problems with lawyers, get MORE lawyers involved.

Sure.

  2. The bigger problem with lawyers, even if they were 50/50 is this:

    Lawyers, by definition, are inclined to believe in the power of "positive law." That is, that EVERY problem can be solved with Laws!

    That's not bad in and of itself; after all, they're paid for that sort of thinking.

    But "positive law" has gone off the rails--and making MORE positive laws will not be the remedy.

    It's sorta like Grothman's problem with suggesting that recalls should be really, really hard to instigate. Since he's a Gummint kinda guy, he tends to think in terms of protecting the Gummint.

    Same with Walker, by the way, whose budget INCREASES State of Wisconsin employment.
