Charlie Sykes brought up an interesting topic today.
Here's the most questionable section of the Cybersecurity Act of 2009:
SEC. 14. PUBLIC–PRIVATE CLEARINGHOUSE.
(a) DESIGNATION.—The Department of Commerce shall serve as the clearinghouse of cybersecurity threat and vulnerability information to Federal government and private sector owned critical infrastructure information systems and networks.
(b) FUNCTIONS.—The Secretary of Commerce—
(1) shall have access to all relevant data concerning such networks without regard to any provision of law, regulation, rule, or policy restricting such access; …
That text covers a whole lot of ground and could easily be misused (!!) in clear violation of the 4th Amendment, according to Morrissey's analysis.
Certainly, the Civil Libertarian (D) folks in Congress will substantially alter that provision, right?
Right?
Don't hold your breath waiting for the ACLU to get excited here. The law is intended to target "Right-Wing Extremists", since Democrats don't believe there are any extremists on the Left. BTW, "Right Wing Extremists" are you and me.
